Terms of Service

1. Acceptance of the Terms

By accessing or using YourAnimeShop.ai (the “Platform”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree, do not use the Platform. These Terms constitute a binding agreement between you and Your Anime Shop, Inc.(“Company,” “we,” “our,” or “us”).

2. Service Description

The Platform allows customers (“you,” “User”) to upload original images that our proprietary AI transforms into anime‑styled artwork (“AI Artwork”) and to order custom physical products printed with that AI Artwork for delivery within the United States. An order‑tracking page lets you monitor shipment status via the unique Order ID displayed at checkout and emailed to you. The Platform is built with Next.js, hosted on AWS, and payments are processed exclusively by Stripe.

3. Eligibility

• You must be at least 18 years old and capable of forming a binding contract.
• You represent that all information provided during checkout is accurate and complete.

4. Order Identification & Security

• We do not require user accounts or logins. Keep your Order ID confidential; anyone with that ID can view status and limited order details.
• We are not liable for unauthorized access caused by your sharing or mishandling of the Order ID.

5. User Content & Acceptable Use

Ownership: You must own, or have all necessary rights to, any images or other content you upload.

Prohibited Content: You agree not to upload, generate, request, or order any content that is:

• Adult or sexually explicit;
• Illegal, infringing, or otherwise unlawful;
• Hateful, harassing, or defamatory;
• Violent or graphic beyond a PG‑13 rating;
• In violation of any third‑party intellectual‑property, privacy, or publicity rights.

We reserve the right to refuse or cancel any order that violates these guidelines.

6. License to Your Content

You grant us a limited, non‑exclusive license to use, reproduce, modify, and display any images you upload solely to generate AI Artwork and fulfill your order. We donot use your images for training, marketing, or any purpose beyond providing the Service, and we delete them within 30 days after order fulfillment. Upon full payment, you receive a perpetual, non‑exclusive license to the resulting AI Artwork for yourpersonal, non‑commercial use only; any commercial exploitation requires our prior written consent and may be subject to additional fees, and the Artwork remains subject to any third‑party rights contained in your original images.

7. AI Artwork & Intellectual Property

• User Rights: All intellectual‑property rights in the AI Artwork are assigned to you upon full payment, subject to any third‑party rights contained in your original images.
• Company IP: All technology, algorithms, trademarks, and other materials provided by the Company remain our exclusive property.

8. Image Security & Deletion

Uploaded images and generated AI Artwork are encrypted at rest and in transit. Unless required by law or to resolve a dispute, we automatically delete all copieswithin 30 days after order fulfillment.

9. Orders, Pricing & Payment

• Prices are displayed in U.S. dollars and may change without notice.
• Payment is collected in full at checkout through Stripe. We never store full card numbers.
• You are responsible for all applicable taxes and shipping fees.

10. Shipping & Delivery

• We currently ship to EU and UK addresses only.
• Delivery estimates are provided at checkout but are not guaranteed.

11. No Returns; Limited Warranty

Because each item is custom‑printed, all sales are final. If your product arrives misprinted, damaged, or materially defective, our Refund Policy describes how to request a replacement or refund.

12. Disclaimer of Warranties

THE PLATFORM AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT. AI ARTWORK MAY VARY IN COLOR OR DETAIL FROM DIGITAL MOCK‑UPS.

13. Limitation of Liability

IN NO EVENT WILL WE BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR ANY AMOUNT EXCEEDING THE GREATER OF $100 OR THE TOTAL FEES YOU PAID US FOR THE ORDER THAT GAVE RISE TO THE CLAIM.

14. Indemnification

You agree to defend, indemnify, and hold harmless the Company and its affiliates from any claims arising out of your (a) breach of these Terms, (b) content, or (c) use of the Service.

15. Refusal of Service

We may refuse, cancel, or limit any order at our sole discretion, including for violations of these Terms or suspected fraud.

16. Modifications

We may update these Terms from time to time. We will post the revised Terms and update the “Last Updated” date. Your continued use after changes become effective constitutes acceptance.

17. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to its conflict‑of‑law provisions. Any dispute will be resolved by binding arbitration in Wilmington, Delaware, under the Commercial Arbitration Rules of the American Arbitration Association, except that either party may seek equitable relief in court for intellectual‑property misuse or confidentiality breaches. You waive any right to participate in a class action.
